The scope of the "General Terms and Conditions" applies to the use of the webshop operated by the Seller, Fishing Time Kft., on its website fishingtime.hu and its subdomains. This agreement is concluded exclusively in electronic form and does not qualify as a written contract; it does not refer to a code of conduct. The contracts are archived and will be sent to the Buyer upon request. Questions related to the website can be addressed via the provided contact information.

Hungarian law shall govern matters not regulated herein, and the interpretation of these GTC, with particular regard to:
The mandatory provisions of the relevant legislation shall be binding on the parties without any special stipulation.
These GTC are effective from **January 08, 2024**, and shall remain in force until revoked. The Seller is entitled to unilaterally modify the GTC. The Seller shall publish the amendments on the websites before they take effect and apply them to orders placed after they enter into force. By using the websites, Buyers accept that all regulations regarding the use of the websites are automatically valid for them.
The products displayed in the webshop can be ordered online; personal purchase is not possible. The products can be identified solely by their article number. It is not possible to place orders over the phone.
The prices displayed for the products are in Forint, include the current VAT, but do not include the packaging and shipping costs. In the webshop, the Seller details the product's name, description, and displays a photo of the products. The images displayed on the product data sheet may differ from reality, in some cases serving as illustrations.
If a promotional price is introduced, the Seller fully informs the Buyer of the duration and conditions of the promotion.
The Buyer opens the fishingtime.hu/webshop website, selects the product(s) they wish to purchase, sets the quantity, and then places the selected product(s) in the basket. The Buyer can view the contents of the basket at any time by clicking on the "finish order" icon in the upper right corner of the website.
If the buyer wishes to continue shopping, they click on the "back to webshop" text. If they have finished shopping, they can check the quantity of the product they wish to purchase or modify it. By clicking on the red circular icon (delete) next to the total amount, they can delete the contents of the basket. After finalizing the quantity, the basket content is automatically updated.
By clicking on "shipping information", the buyer enters the shipping address and then selects the payment method from the following options.
Prepayment options (PayPal, online bank card payment, bank transfer) are only possible for products in stock.
Shipment outside the country's borders is undertaken exclusively with prepayment, and with shipping costs calculated retrospectively and added to the order.
The Buyer may request the retention of their order for a maximum of 7 calendar days when placing the order. If the Buyer does not give instructions regarding the order within 7 days, the Seller is entitled to ship or cancel the order. If the Seller offers a price guarantee for a product, it can only be redeemed for new orders within 24 hours of the offer.
By clicking on the "order review" button, the Buyer can check their details, payment method, and the product they wish to purchase one more time, and can modify them by clicking on the yellow "basket content" or "shipping information" button in the upper header. The Buyer can review and expressly approve the General Terms and Conditions containing the terms of purchase again before finalizing the order and before submitting the order.
By placing the order, the User acknowledges that, according to Section 15 of Government Decree 45/2014. (II. 26.) and other terms (e.g., Section 20), a payment obligation arises with the order.
If the Buyer finds everything in order, they can submit their order by clicking on the "send order" button. Following this, the Buyer receives a confirmation email about their order, detailing all the costs incurred by them and the final amount to be paid. If the order confirmation email does not arrive within 24 hours, the Buyer is released from the offer commitment or contractual obligation. The order and its confirmation are considered to have reached the Seller or the Buyer when they become accessible to them. The Seller is exempt from liability if the confirmation does not arrive on time because the Buyer provided a faulty or incorrect email address during registration, or cannot receive an email due to the mailbox being full.
The Seller draws the Buyer's attention to the fact that if the Seller does not take delivery of the ordered product(s) performed in accordance with the contract (regardless of the payment method), they commit a breach of contract and thus fall into default according to Section 6:156 (1) of the Ptk.
This means that, based on the rules of management without mandate – if the Buyer does not indicate their intention to withdraw (and does not make a statement on whether they intend to take delivery of the ordered product(s)) – the Seller will enforce the fulfillment fee, plus packaging material fee and the shipping cost (round trip) related to the product(s) against the Users.
The Seller draws the Buyer's attention to the fact that, in order to enforce the legal claims thus arising, it uses the assistance of a collection agency and/or a lawyer, so the Buyer is also responsible for paying other (legal) costs arising from the breach of contract (even the fees of the payment order procedure).
If an error or omission occurs in the webshop regarding the prices or the products, the Seller shall immediately correct the error and omission upon becoming aware of it. Subsequently, the Seller immediately informs the Buyer about the new data, who can then confirm the order once more, but either party may withdraw from the contract. A price is especially erroneous, among other things, if it is clearly mistaken or disproportionate.
There is no minimum and maximum order value in the webshop.
The goods remain the property of the Seller until the full amount is paid.
You agree that communication concerning the contract shall take place in electronic form.
Orders awaiting packaging that are Cash on Delivery or not yet paid for can be modified exclusively by e-mail, referring to the order ID (FT.....) and specifying the article number and quantity. It is not possible to modify the content of orders that have already been packaged or paid for.
The shipping cost for delivery within the borders of Hungary on a working day, up to 1 day from the placement of the order, is 1790 Ft with GLS home delivery, 1590 Ft with GLS parcel point delivery, 1190 Ft to a Foxpost parcel machine, and 1499 Ft as a parcel remaining at the post office. (The final amount of the order is understood to include any discounts.) The COD fee is 599 Ft.
If the sum of the price of the ordered products (excluding shipping costs) reaches **14,999 Ft** and the buyer settles it with prepayment (e.g., online bank card payment, PayPal, or bank transfer), we deliver it to the selected post office (as a parcel to be collected at the post office) **FREE OF CHARGE**.
The Buyer is obliged to examine the package upon delivery in the presence of the courier, and in case of any damage noticed on the products or packaging, they are obliged to request the preparation of a report, and in case of damage, they are not obliged to accept the package. Subsequent complaints without a report will not be accepted.
Packages are delivered on weekdays between 8:00 AM and 5:00 PM for conventional parcels.
It may occur that the order contains products that, due to their shape, cannot be packaged next to each other (e.g., a chair or a bed with a fishing rod); in such cases, the order will be shipped as a consignment consisting of multiple packages on the same day, but their delivery is expected on consecutive working days. In the case of a consignment consisting of multiple packages, the main package contains the total amount of the order.
Before the package is delivered, the courier company sends a notification to the email address provided by the Buyer regarding the expected time of delivery.
In case of re-sending an uncollected, refused (and therefore returned to the Seller) package, we charge a shipping cost of 3998 Forint.
In case of broken-down orders, all further delivery costs are also borne by the Buyer, the fee for which is 1790 Ft.
Return shipping is 2150 Forint as follows: the package prepared by the Buyer, packed in a five-layer cardboard box and padded with void fill, is picked up by the courier at the address provided by the Buyer and returned to our premises. Outside the borders of Hungary, the Seller only sends packages after prepayment. In such a case, the shipping cost is calculated retrospectively and added to the value of the order, the amount of which depends on the weight and size of the package, and the country where the package arrives.
The invoice and the warranty certificate (if necessary) are sent electronically to the email address from which the Buyer placed the order, no later than 72 hours after the completion of the order.
Cash on Delivery or settled orders placed on working days until 2:00 PM are delivered by the courier service within a maximum of two working days, provided the Buyer does not indicate a different delivery day. A further condition for this is that all products ordered by the Buyer are immediately available in stock. This is indicated by a green "in stock" label next to the "add to basket!" button of every product.
In the case of products marked **"external warehouse"**, the arrival time at the Seller's premises is 2–3 working days, but for certain partners, this can take up to 1–2 weeks, such as Fox, Carp Academy, Döme, Pure Fishing products (Berkley, Abu, Shakespeare, Penn, Spiderwire, Greys, Chub, JRC, Sebile). If the product is not in stock and can be delivered significantly later than the indicated delivery deadline, the Seller informs the Buyer by phone or e-mail about the expected time of delivery.
The **"a few days"** marking is used for products that the supplier keeps in stock, but there is no current stock information about the product's availability. **"Low supplier stock"** marks products of which 1–2 pieces are available at the supplier, so we cannot always deliver these. If they are not procurable, these products are canceled from the order, and the buyer receives notification by e-mail.
The arrival of products marked **"on order"** can take several weeks; these are typically not in stock even at the domestic wholesaler or there is no direct information about the warehouse stock.
The **"not orderable"** products are out of stock, their arrival is uncertain, so the Seller does not accept orders for them.
If the Seller does not fulfill the ordered and confirmed product because the product is not available to them, they are obliged to inform the Buyer immediately and to refund the amount paid by the Buyer immediately, but no later than within 14 (fourteen) days. The fulfillment of this obligation does not exempt the Seller from other consequences of their breach of contract.
The Seller is not responsible for the change of technical specifications, descriptions, and information by the supplier without prior notice due to reasons beyond their control. The Seller reserves the right to reject already confirmed orders in whole or in part if the supplier does not undertake the delivery. Partial fulfillment can only take place after prior consultation with the Buyer.
By accepting these general terms and conditions, the Buyer expressly consents and acknowledges that in case of the Seller's faultlessness due to the exceeding of the pre-announced delivery time, the Seller is not liable for compensation.
The Buyer considered a consumer may exercise their right of withdrawal within 14 (fourteen) calendar days from the receipt of the product and the conclusion of the contract for the use of the service. The consumer may also exercise their right of withdrawal in the period between the conclusion of the contract and the receipt of the product. The buyer can withdraw from the contract by e-mail, and can exercise their right of withdrawal with an unambiguous statement to that effect: via the model statement specified in Annex 2 of Government Decree 45/2014. The cost of returning the product shall be borne by the Buyer. When exercising the right of withdrawal, the Buyer shall not be charged any costs other than the cost of returning the product, however, the Seller may claim compensation for the depreciation resulting from use exceeding what is necessary to ascertain the nature, characteristics, and functioning of the product.
In the following cases, the buyer is not entitled to the right of withdrawal:
After the return of the product, the Seller shall immediately, but no later than 14 calendar days from the return of the product to the premises, refund the paid amount to the Buyer in accordance with the above regulations. If there was a shipping fee during the purchase and the Buyer withdraws from the entire order, the paid shipping fee will also be refunded. However, the Seller has a right of retention. After checking the returned products, the Buyer receives information by e-mail. The Seller refunds the amount to be refunded in the same way as the original payment method. The Buyer is not charged any additional costs resulting from the refund. If the Buyer requests a different method of refund in writing from the Seller, they shall notify this at the following email address: info@fishingtime.hu. The Seller is not responsible for erroneous transfers resulting from an incorrectly provided bank account number. We are not able to refund the purchase price in cash on site; a refund by postal cheque can only happen if the Buyer paid the purchase price by cash on delivery.
The Seller is not obliged to reimburse the Buyer for the additional costs resulting from the Buyer choosing a delivery method other than the cheapest standard transportation method offered by the Seller.
The Service Provider may withhold the refund until it has received the goods or the Buyer has provided proof that they have sent them back: the earlier of the two dates shall be taken into account.
The Buyer must send back the goods without undue delay and in any case no later than 14 days from the day on which they communicate their withdrawal from the contract to the Seller, or hand them over at the address designated by the Seller.
If the Buyer wishes to exercise their right of withdrawal, they can signal this in writing (even with the help of the attached form) through one of the Seller's contact details. In case of written notification by post, the date of posting shall be taken into account. The Buyer can return the ordered product to the Seller by post or with the help of a courier service.
The Buyer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
The Buyer bears only the direct cost of returning the product, but a maximum of 2000 Forint, if they do not return it using the return pick-up option provided through the Seller's GLS contract. The Seller may withhold the refund until it receives the product or products, or the Buyer has provided proof that they have sent them back: the earlier of the two dates shall be taken into account. If the Buyer wishes to exercise their right of withdrawal, they can signal this in writing (even with the help of the attached form) through one of the Seller's contact details. In case of written notification by post, the date of posting shall be decisive.
The Buyer can return the ordered product to the Seller by registered mail or via a courier service. Within 14 days of the product's return, the Seller shall refund the purchase price of the product, together with the shipping cost, but excluding the return shipping cost, which is borne by the Buyer.
If the buyer used a discount coupon tied to a minimum order value during the purchase, and then partially withdraws from their order, and the total value of the products they wish to keep does not reach the minimum order amount required for the coupon to be valid, the amount reduced by the value of the coupon will be refunded.
The buyer is not considered a consumer if they order as a company, thus they are not entitled to the right of withdrawal without reason within 14 days. A consumer is a natural person acting outside their trade, business, craft, or profession.
The purchase price of the product will be transferred back to the Seller after the product's return, as described above.
After the 14th day and within the 30th day from the purchase, the Seller will repurchase the product in unused, new condition, in its original unopened packaging.
If the Buyer refuses to accept their order or it is returned with the marking "not collected", the Seller will only accept their orders with prepayment in the future, and may claim reimbursement of the shipping, packaging, and general costs related to the package.
In case of withdrawal from the contract, the cost of returning the product is borne by the Buyer. The purchase price of the product will be transferred back by the Seller after the product's return to the bank account number sent by the Seller via email; we are unable to initiate a transfer to a bank account number provided in paper format.
The Seller does not take over packages sent to them via Cash on Delivery.
The Buyer undertakes to return the product in packaging that prevents damage during shipping. The Buyer also undertakes that in case of returning a fishing rod, they will return the product in the cardboard tube sent during the purchase or an equivalent one. When returning products where the factory packaging and the product form an integral unit (e.g., paper boxes of reels, boots, fish finders, etc.), the Buyer undertakes to return the factory packaging of the product to the Seller undamaged as well. The Seller is entitled to refuse the acceptance of a damaged package.
The Buyer returns the product(s) to the premises of Fishing Time Kft.'s logistics partner (WhiteFish Log. Kft.) at 2051 Biatorbágy, Mészárosok útja 2-4., Building 6, Ramp 47. In the case of products returned personally, we charge an administrative fee of 1499,- Forint per occasion, which will be deducted from the final amount of the invoice when refunding the price of the product or products.
Choose a box of suitable size and quality for the size, quantity, and weight of the product. The products are rotated, stacked on top of each other, and reloaded several times; the box must withstand all this until it returns to our warehouse. Choose a five-layer or equally strong, quality box. Please do not send products in a box that is materially damaged or has been used multiple times. The product should not directly touch the wall of the box; it should fit comfortably in it, and use void fill material to pad the product so that it cannot move. If you are returning multiple products, they should not touch each other either; pack them individually. Seal all sides of the cardboard box with adhesive tape.
A video recording is made in every case of the acceptance and unpacking of the products.
If the Buyer chose an unsuitable product (wrong size, casting weight, etc.) and wishes to **"exchange"** it, they must withdraw from the purchase, return the product to the Seller's premises at their own expense, and the Seller will transfer the purchase price back to the bank account number provided by e-mail. For the delivery of the desired exchange product, a new order must be placed by the Buyer in every case.
In case of a quality complaint, the Buyer shall immediately communicate the defect to the Seller upon discovering it and present the product at the Seller's premises. The return of the product to the Seller's premises is the Buyer's responsibility and cost. The Seller suggests the exchange, repair, or refund of the purchase price of the product depending on the defect of the product. The complaint cannot be decided based on electronically sent photos. After checking the returned products, the Buyer receives information by e-mail. The Buyer attaches the proof of the amount of the refund cost to the package, and if the Seller deems the quality complaint justified, they shall reimburse and transfer the purchase price of the product and the cost of the refund to the Buyer's bank account, as a result of which the Buyer shall not be charged any additional costs. The Buyer provides their bank account number to the Seller in writing, in electronic form to the email address info@fishingtime.hu. The Seller is not responsible for erroneous transfers resulting from an incorrectly provided bank account number.
If a product returned with an unfounded quality complaint, withdrawal, or for other reasons arrives at the premises of our logistics partner, the courier service will deliver it again at the Buyer's expense for a shipping fee of 1,799 Forint, and the Seller charges an administrative fee of 1,799 Forint.
Personal collection of the products is possible at the premises of the Seller's logistics partner (White Fish Logisztika Kft. 2051 Biatorbágy, Mészárosok útja 2-4., Building 6, Ramp 47), on working days from Monday to Thursday (closed on Friday) during opening hours.
The Seller shall in all cases prepare an electronic record of the quality complaint or complaint.
In case of defective performance by the Seller, the Buyer may assert a warranty claim for defects against the Seller in accordance with the rules of the Civil Code.
The Buyer may – at their option – exercise the following warranty claims for defects: they may request repair or replacement, unless the chosen method of fulfillment is impossible or would result in disproportionate additional costs for the Seller compared to the fulfillment of another claim. If the Buyer has not requested or could not request repair or replacement, they may request a proportional reduction of the consideration or may repair the defect themselves or have it repaired by another person at the Seller's expense, or – ultimately – may withdraw from the contract. The Buyer may switch from their chosen warranty right to another one, but the Buyer shall bear the cost of the switch, unless it was justified or the Seller gave cause for it.
The Buyer is obliged to communicate the defect immediately after its discovery, but no later than two months from the discovery of the defect. Beyond the limitation period of 2 (two) years from the performance of the contract, the Buyer can no longer assert their warranty rights for defects.
The Buyer may assert their warranty claim for defects against the Seller.
Within 6 (six) months from the performance, the assertion of the warranty claim for defects is not subject to any further condition other than the communication of the defect, if the Buyer proves that the product or service was provided by the Seller operating the webshop. After the expiry of 6 (six) months from the performance, however, the Buyer is obliged to prove that the defect recognized by the Buyer already existed at the time of performance.
In case of a defect in a movable property (product), the Buyer may – at their option – assert a warranty claim for defects or a product warranty claim.
As a product warranty claim, the Buyer may only request the repair or replacement of the defective product.
A product is defective if it does not comply with the quality requirements in force when it was placed on the market, or if it does not have the properties specified in the description given by the manufacturer.
The Buyer may assert their product warranty claim within 2 (two) years from the product's placement on the market by the manufacturer. After the expiry of this deadline, they lose this right.
The Buyer can only exercise their product warranty claim against the manufacturer of the movable property or the Seller. The Buyer must prove the defect of the product in case of asserting a product warranty claim.
The manufacturer (Seller) is only exempt from their product warranty obligation if they can prove that:
It is sufficient for the manufacturer (Seller) to prove one reason for the exemption.
We draw your attention to the fact that you cannot assert a warranty claim for defects and a product warranty claim simultaneously, in parallel, for the same defect. However, in case of successful assertion of your product warranty claim, you may assert your warranty claim for defects regarding the replaced product or the repaired part against the manufacturer.
In case of defective performance, the consumer is entitled to a guarantee for 1 (one) year from the purchase for products belonging to the product groups listed in Annex 1 of Government Decree 151/2003. (IX. 22.) on the mandatory guarantee for certain durable consumer goods. The Seller sends the warranty certificate electronically to the electronic mailing address provided by the Buyer in their order within 72 hours of the package delivery. In the case of a voluntary guarantee undertaken by certain manufacturers, the Seller communicates its detailed terms in connection with the description of the given product.
The guarantee period begins with the handover of the product to the consumer, or if the commissioning is performed by the distributor or its agent, with the day of commissioning.
The Seller is exempt from its guarantee obligation only if it proves that the cause of the defect arose after the performance. We draw your attention to the fact that you cannot assert a warranty claim for defects and a guarantee claim, or a product warranty claim and a guarantee claim simultaneously, in parallel, for the same defect, but otherwise the Buyer is entitled to the rights arising from the guarantee independently of the entitlements described in the chapters on product warranty and warranty for defects.

The domain www.fishingtime.hu is the property of Fishing Time Kft., the content on the www.fishingtime.hu page is the property of Fishing Time Kft. The copying, use, or taking over of the intellectual products of Fishing Time Kft. (including electronically sent warranty certificates, operating and use instructions), and the content of the website, in unchanged or largely identical content, both textual and visual, is prohibited and subject to a fee without the separate written consent of Fishing Time Kft. The product data, product descriptions, and product photos found on the website may only be used and displayed on another website with the user right granted by Fishing Time Kft.
If Fishing Time Kft. demonstrably detects this data in an identical form on the website of a third party, it will enforce its claim for contractual penalty.
The third party expressly acknowledges and accepts its obligation to pay a contractual penalty by copying, taking over, and displaying the content of the website on its own website, according to which it is obliged to pay a contractual penalty of 200 EUR per copied paragraph. The unauthorized user also accepts that in case of using notarial certification for proof, the existence of the certification itself proves the fact of copying.

Should the Seller or the Buyer not exercise a right due to them under the GTC, the failure to exercise such right shall not be considered a waiver of that right. Any waiver of a right shall only be valid if made in an **express written declaration** to that effect.
The Seller and the Buyer shall attempt to settle their disputes peacefully. In the case of a consumer dispute, the consumer may also initiate proceedings before the **Conciliation Body** operating alongside the county (metropolitan) chambers of commerce and industry.

The Fishing Time Webshop strives to fulfill every order in accordance with its commitments and to the **maximum satisfaction** of the Buyers. If the Buyer turns to the Seller with a complaint regarding the contract or its performance, the complaint may be communicated via the **info@fishingtime.hu** e-mail address or by letter. The Seller shall investigate the complaint and inform the Buyer of the result within **30 days**. The Seller shall state the reasons for its position rejecting the complaint. A copy of the response shall be retained for 3 years and shall be presented to the inspecting authorities upon request.
